Every hosta in this collection is protected by plant patent legislation — meaning the cultivar has been formally recognized as a unique, distinct, and new variety by a government patent office. Purchasing a patented hosta from Hosta Choice Gardens means you are receiving a genuine, legally propagated plant grown in full compliance with the terms of its patent.
Canadian Plant Breeders' Rights (PBR)
In Canada, new hosta cultivars may be protected under the Plant Breeders' Rights Act, administered by the Canadian Food Inspection Agency (CFIA). A Plant Breeders' Right grants the breeder exclusive control over the propagation, sale, and import/export of the protected variety for a period of up to 25 years. At Hosta Choice Gardens, all Canadian PBR-protected hostas in our collection are propagated under proper authorization. When you purchase one of these cultivars, you are supporting the breeders and hybridizers who dedicate years of work to developing exceptional new varieties.
United States Plant Patents (USPP)
Many of the world's most celebrated hosta cultivars — including those from the renowned Proven Winners® Shadowland® program — are protected by United States Plant Patents (USPP), issued by the United States Patent and Trademark Office (USPTO). A US plant patent grants the patent holder exclusive rights to asexually reproduce and sell the variety for 20 years from the date of filing. Hosta Choice Gardens sources all USPP-protected cultivars through authorized channels, ensuring every plant in this collection is legally propagated and true to its registered description.
